Responsibilities

You

  • Must notify trustee of all address and job changes within 7 days of the change.
  • Must mail, e-mail or fax any letters from new collection agents for the debts included in your plan.
  • Are responsible for all payments that are not deducted or properly deducted from your paycheck.
  • Are responsible to read everything that we give and/or send to you.  You will be given a Red File Jacket to hold all of your documents. Please use it and refer to it first when you have questions.
  • Are responsible to make sure that errors in your credit bureau are reported to the credit bureau and to insure that each creditor has marked your debt as paid in full once the 128.21 plan has been successfully completed.
  • Are responsible to send a Cease & Desist letter to your creditors if they are contacting you. You are the first line of contact. Your trustee is the second line of contact.

 

Trustee

  • Notify creditors and give them an opportunity to respond to the claim amount.
  • Create a plan that will pay in full all of the creditors in a time frame that does not exceed 3 years.
  • Disburse the funds to the creditors according to the Court Approved Plan.
  • Communicate with creditors as necessary.
  • Dismiss the action to the Court (paid in full or for default) and notify the creditors of the dismissal.
  • Provide you with copies of your payment plan and subsequent dismissal documents.

 

Although it is not the duty of the Trustee, Sandie will provide you with substantial educational information that will assist you with situations that may come up during the 128.21 action or after it has been paid.
