Preparation for a Section 128.21

Information you should have ready if you are planning to file a WI Chapter 128.21 action:

  • Income—at least one if not two paycheck stubs to help determine your exact income.
  • Budget Information—knowledge of your monthly bills and living expenses.
  • Debts—invoices or monthly statements for the debts that you have.  The trustee will require these so that she has full addresses and account numbers.  You can create a list if you desire; however, the original invoices or copies of both front and back, will be required.
  • If you have payday loans, a contract stating the address and account number is necessary. If the loan was made online, you may have to investigate to find a mailing address for the company. Many online payday companies are offshore—not in the US.  It is not the Trustee’s responsibility to find addresses; however, if you are having difficulties locating an address, the Trustee may already have it on file. Ultimately, if no address is available, the debt will have to be eliminated from the 128.21 plan.
